The terms on which you may use IOPC Careers Hub |

These Terms of Use (together with the other documents referred to below) set out the terms on which you may use the IOPC Careers Hub, Welcome to the IOPC Careers Hub (policeconduct.gov.uk), and your relationship with us in relation to IOPC Careers Hub. |

You should read these Terms of Use carefully before registering for or using IOPC Careers Hub, as by registering for and / or using IOPC Careers Hub you are confirming that you accept these Terms of Use and that you will comply with them. |

Changes to these Terms of Use and our other policies |

We make changes to these Terms of Use from time to time. Any changes will be notified to you via the email address provided by you on registration or via a notice on the IOPC Careers Hub. The changes will apply to the use of IOPC Careers Hub after we have given notice. If you do not wish to accept the changed Terms of Use you should delete your account and not continue to use IOPC Careers Hub. If you continue to use IOPC Careers Hub after the date on which the change comes into effect, your use of the IOPC Careers Hub indicates your agreement to be bound by the changed Terms of Use. |

We, the Independent Office for Police Conduct (IOPC), operate the IOPC Careers Hub at Welcome to the IOPC Careers Hub (policeconduct.gov.uk). We are a non-departmental public body, established as a body corporate under the Police Reform Act 2002, as amended by the Policing and Crime Act 2017. |

Registration |
||
4.1 |
The IOPC Careers Hub is provided for your personal use subject to these Terms of Use and our privacy and cookies policies. You must register an account on IOPC Careers Hub in order to use the full IOPC Careers Hub, although you may use the jobs search facility Jobs and careers with IOPC (policeconduct.gov.uk) without registering. |

4.2 |
Please ensure that the details provided by you on registration or at any time are correct and complete. |
||
4.3 |
Please inform us of any changes to the information that you provided when registering by updating your personal details. |
||
5. |
Restrictions on your use of IOPC Careers Hub |
||
5.1 |
You may only use IOPC Careers Hub for lawful purposes and in compliance with all applicable laws, including without limitation data protection and privacy laws, laws relating to copyright of content and laws relating to unsolicited commercial electronic messages. |

5.2 |
In addition, you must not: |

5.2.1 |
use IOPC Careers Hub to send or transmit, whether directly or indirectly, unsolicited or unauthorised advertising or promotional material, chain letters or pyramid selling schemes; |
||
5.2.2 |
use IOPC Careers Hub for mail bombing or flooding or to make deliberate attempts to overload a system; |
||
5.2.3 |
use IOPC Careers Hub to post content or link to content where you know that or ought to have known that the owner of that content has not consented to or authorised that posting or linking or where that posting or linking infringes the rights of that owner; |
||
5.2.4 |
knowingly or recklessly introduce to IOPC Careers Hub, or use IOPC Careers Hub to transmit, any application, material or ware (such as viruses, spyware, malware or adware) which are malicious or harmful; |
||
5.2.5 |
attempt to gain unauthorised access to IOPC Careers Hub, the server, equipment or network on which IOPC Careers Hub is stored, any server, computer or database connected to IOPC Careers Hub or any software; |
||
5.2.6 |
use IOPC Careers Hub to attempt to gain unauthorised access to any other website, internet account, server, computer, equipment, system, network, data or information; |
||
5.2.7 |
use IOPC Careers Hub to monitor data or traffic on any network or system; |
||
5.2.8 |
use IOPC Careers Hub to collect or use information, including without limitation email addresses, screen names or other identifiers, by deceit (such as phishing, internet scamming, password robbery, spearing, scraping and harvesting); |

5.2.9 |
use IOPC Careers Hub to distribute software; |
||
5.2.10 |
carry out a denial-of-service attack or a distributed denial-of-service attack on IOPC Careers Hub or use IOPC Careers Hub to carry out any such attack on any other website; |

5.2.11 |
use our website: |

5.2.11.1 |
for any purpose which; or |
||
5.2.11.2 |
to send, transmit, publish, upload, download, use, store, reproduce or knowingly receive any material that does not comply with the content standards set out in paragraph 9; |

5.2.12 |
use IOPC Careers Hub to groom, harm or take advantage of minors in any way or to attempt to do so; or |
||
5.2.13 |
use IOPC Careers Hub in violation of export laws, controls, regulations or sanction policies of the United States or any other country. |

5.3 |
If you breach any term of these Terms of Use your right to use IOPC Careers Hub will immediately end. In addition we may take such other actions including, without limitation, legal action as we consider appropriate. |

5.4 |
If you breach any term of these Terms of Use, or if we receive a request from a law enforcement authority to do so, we may report your identity, details of any breach and any other information we consider necessary to relevant law enforcement authorities. |
||
5.5 |
You will compensate us for any losses, liabilities, costs, expenses, claims or proceedings that we suffer or incur, or will suffer or incur, as a result of or in connection with any breach by you of your obligations in paragraphs 5.1 and 5.2. |

6. |
Passwords and security requirements |

6.1 |
Use of the full IOPC Careers Hub is password protected. In order to access it you will need a password. It is your responsibility to keep this information secret and confidential and not to disclose it to any other person. You will be responsible for all activities that occur or are submitted using your password. |
||
6.2 |
If you think that somebody else might know your password then you must log in to your account and change it. Where you suspect that there may have been misuse or other suspicious activity related to your password or registered user details please let us know by telephoning or emailing us using the contact details above as soon as possible. |
||
6.3 |
We reserve the right to disable your account at any time if, in our reasonable opinion, you fail to comply with any of these Terms of Use, if we consider that you are using IOPC Careers Hub to download content or infringe in any manner the rights of another person, if we consider that there may be a security risk or on any other reasonable grounds. |
||
6.4 |
The services provided by the IOPC Careers Hub do not include the provision of computer or other necessary equipment to access the IOPC Careers Hub. To use the IOPC Careers Hub site you will require internet connectivity and appropriate telecommunication links. We shall not be liable for any telephony, connectivity or other costs that you may incur. |

7. |
IOPC Careers Hub and its content |

IOPC Careers Hub is made available to you free of charge. |
||
7.2 |
We do not guarantee that access to IOPC Careers Hub, or the content on it, will always be available or uninterrupted. Your right to access IOPC Careers Hub is given on a temporary basis only. Should IOPC Careers Hub be unavailable at any time and you need to submit an application or undertake some other interaction urgently, or in the event of other accessibility issues, please contact jobs@policeconduct.gov.uk. |

7.3 |
We reserve the right to change IOPC Careers Hub and the content on it, including without limitation by adding or removing content or functionality, at any time. |

7.4 |
We cannot guarantee that all content on IOPC Careers Hub is accurate, complete or up to date. We therefore make no warranties, representations, undertakings or guarantees that the content on IOPC Careers Hub is accurate, complete or up to date. |

7.5 |
We make no warranties, representations, undertakings or guarantees that IOPC Careers Hub or any content on it will be free from errors or omissions. |

7.6 |
The content on IOPC Careers Hub is made available to provide information as to job opportunities at IOPC and as a means to apply for these roles and for general information purposes only. Nothing on IOPC Careers Hub is intended to be advice on which you should rely. You should always obtain appropriate specialist advice before taking, or not taking, action on the basis of any content on IOPC Careers Hub. |

We make no warranties, representations, undertakings or guarantees that IOPC Careers Hub is secure or free from bugs or viruses. You are responsible for ensuring that the device from which you access IOPC Careers Hub has suitable anti-virus software in place. |

We reserve the right to withdraw or discontinue use of the IOPC Careers Hub at any time at our discretion. |

8. |
Content uploaded to IOPC Careers Hub by you or by other users |

8.1 |
If you upload content to IOPC Careers Hub you must comply with the content standards set out in paragraph 9 in respect of that content. |

8.2 |
You warrant to us that you own any content which you upload to IOPC Careers Hub or, if you are not the owner, that you have the right to upload it. |
||
8.3 |
You will continue to own any content which you upload to IOPC Careers Hub, but for so long as that content remains on IOPC Careers Hub you grant us a world-wide licence to use, store, copy, distribute, display and make available that content and to permit other users of IOPC Careers Hub to use, download and reproduce it in accordance with our Terms of Use. |

You will compensate us for any losses, liabilities, costs, expenses, claims or proceedings that we suffer or incur, or will suffer or incur, as a result of or in connection with any breach by you of your obligations or warranties in this paragraph 8. |

We are not responsible for, and make no warranties, representations, undertakings or guarantees in respect of, any content on IOPC Careers Hub which is uploaded by a user. Any view expressed by any user of IOPC Careers Hub is their view and not our view nor the view of our officers or employees. |

We reserve the right to remove any content that you have uploaded to IOPC Careers Hub at any time. |
||
8.7 |
We also reserve the right to disclose your identity to any person who claims that any content you have uploaded to IOPC Careers Hub infringes their intellectual property rights or their right to privacy or is defamatory. |

Content standards |

Please remember that any content you upload to our website may be viewed by other users, so always think carefully before you submit any content. |

Any content that you upload to our website must: |

comply with all applicable laws; |

be accurate (where it states facts); and |

be genuinely held (where it states opinions). |

is defamatory, obscene, offensive, indecent, malicious, hateful or inflammatory; |

is discriminatory based on race, sex, religion, nationality, language, disability, gender, sexual orientation or age; |

solicits or attempts to solicit passwords or personal identifying information for commercial or unlawful purposes from other users; |

is fraudulent or likely to deceive any person; |

is made in breach of any legal duty owed to anyone else, such as a contractual duty or a duty of confidence or is content which is a trade secret where you are not the trade secret holder; |

creates a risk to a person’s health or safety or public health or safety; |

promotes or constitutes illegal or unlawful activity; |
||
9.3.12 |
promotes any political activity; |
||
9.3.13 |
compromises national security; |
||
9.3.14 |
interferes with an investigation by a law enforcement or regulatory authority; |

9.3.15 |
is threatening or abusive or invades another person’s privacy or causes annoyance, inconvenience or needless anxiety; |

is likely to harass, upset, embarrass, alarm or annoy any other person; |
||
9.3.17 |
impersonates any person or misrepresents your identity or affiliation with any person; |

gives the impression it comes from us; |
||

constitutes advertising material; or |
||

advocates, promotes or assists any unlawful activity, including but not limited to copyright infringement or computer misuse. |

Report abuse If you find any content which other users have uploaded to IOPC Careers Hub offensive or if you feel it violates our Terms of Use, please contact us immediately at jobs@policeconduct.gov.uk. |

11. |
Intellectual property rights |

11.1 |
We, or our licensors, own the copyright and all other intellectual property rights in IOPC Careers Hub and all content on it other than content uploaded by or linked to by others. |

11.2 |
You may download the content we own from IOPC Careers Hub and/or print one copy of any page on IOPC Careers Hub for non-commercial purposes You must not make any changes to any content which you have downloaded or printed from IOPC Careers Hub. If you reproduce the downloaded or printed content in any medium you must ensure that you reproduce it accurately and completely and include a statement acknowledging that it is sourced from IOPC Careers Hub. |

No licence is granted to you in these Terms of Use to use any logo or other branding of IOPC. |

If you use, download, print or reproduce content from IOPC Careers Hub in breach of these Terms of Use your right to use IOPC Careers Hub will immediately end and you must return to us or destroy (at our option) all digital and paper copies of the content that you have made. |

Links from IOPC Careers Hub to other websites IOPC Careers Hub may contain links to other websites from time to time. These links are provided for your convenience. We have no control over, and no responsibility or liability to you for, those other websites or their content. |

You may create a link to IOPC Careers Hub from another website, but only if you comply with the following conditions: |

any other matter for which we are not permitted by law to exclude or limit our liability. |

As these Terms of Use govern your access and use of IOPC Careers Hub, subject to paragraph 14.1, all warranties, conditions and other terms relating to IOPC Careers Hub and/or its content which would otherwise be implied by law (whether by statute, common law or otherwise) are excluded. |

Subject to paragraph 14.1, we will not be liable to you for any loss or damage arising out of or in connection with your use of (or inability to use) IOPC Careers Hub or your use of or reliance upon any content on IOPC Careers Hub, whether in contract, tort (including without limitation negligence), misrepresentation, restitution, under statute or otherwise. |

Applicable law |

These Terms of Use are governed by the law of England and Wales and the courts of England and Wales have non-exclusive jurisdiction to determine any dispute arising out of or in connection with them. If you are resident in Scotland you may also bring proceedings in Scotland and if you are resident in Northern Ireland you may also bring proceedings in Northern Ireland. As an individual, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms of Use affects your rights as an individual to rely on such mandatory provisions of local law. |
